Murdo Fraser MSP’s proposed Bill would create tougher punishments for fly-tipping. The Bill would impose strict liability on the individuals who generate the waste for clearing it up, paying for its disposal and would introduce tougher standardised sanctions including lifting the current fixed penalty notice threshold of £200.

The Bill would introduce better data collection and reporting mechanisms. It would also ensure that the individual on who’s land the material is dumped is not legally responsible for its removal.

No action has been taken in the majority of recent fly-tipping cases. Over the past three years there have only been 114 cases of fly-tipping reported to the Crown Office and Procurator Fiscal. No action was taken in 79 of these cases, while only nine were taken to court. This shows that the current legislation, which dates back to the 1990s, are in need of strengthening.
